Invoking the Insurrection Act: The Right Thing to Do?
Abstract:
In 2020, President Trump considered invoking the Insurrection Act to address the widespread civil unrest that erupted following the death of George Floyd. Ensuing debate centered around whether or not it is appropriate to use active duty military force to quell incidents of domestic civil unrest. Although the president has the authority to deploy military force domestically, under the Act, to perform law enforcement functions and quell incidents of civil unrest, it is both unnecessary and inappropriate to do so.
