Abstract:

This thesis investigated legal criteria involved in deciding differing site condition DSC disputes in construction contracting. Legal precedent was researched to determine rules used by the courts. The rules were arranged in a flowchart as a guide for construction professionals to use to resolve DSC disputes. Each rule was discussed and examples of cases were provided. The rules used to decide DSC disputes were found to be consistent between jurisdictions. The use of soil reports in deciding DSC disputes was also researched. The elements and steps of a complete soil report are listed and discussed along with common problems in soil reports which have led to court cases.
