An Investigation of Construction Contract Dispute Cases Lost at the Armed Services Board of Contract Appeals Level.

The Armed Services Board of Contract Appeals ASBCA is responsible for resolving contract disputes between the Armed Services and Civilian Contractors. The invent of this thesis is to examine those Armed Services Board of Contract Appeals Level ASBCA cases that were resolved in the favor of the contractor to determine if a pattern of problem areas exist among construction contract disputes or if there is a single claim category that is predominant among the population of cases lost by the government. A total of thirty-one disputed construction cases were examined in this study. Each examined case was heard before the Armed Services Board of Contract Appeals Level ASBCA during the period between 1982 and 1985. The particulars relevant to each case were recorded on a case review form and analyzed. The results of the analysis indicate that disputes related to specifications are overwhelmingly the most frequent occurring claim. As such, recommendations are provide that will contribute to the minimization of discrepancies related to specifications.
