Abstract:

My paper reviewed the Department of the Navys recent termination of consultation under section 106 of the National Historic Preservation Act regarding the introduction of EA-18G Growlers at Whidbey Island. The paper focused on the Advisory Council on Historic Preservations post-termination letter to the Secretary of the Navy, which commented on the Navys handling of the consultation, to determine whether these comments created any litigation risk for the Navy.
