Abstract:

It is the authors contention that the federal judiciary is a maker of national public policy but that in the recent past, it has dominated the effecting of social justice for our citizens. The reason for this dominance has been the inaction and dalliance of our elected officials the legislators and executives. What is needed is for the legislators and administrators to take the lead in insuring that social change is accomplished in accordance with the mandate of the electorate. Activism is a better function for the executive and legislative branches of government. The federal judiciarys primary role should be one of insuring adherence to the Constitution and interpreting its provisions. Modified author abstract
